1. Acceptance of Terms
By accessing or using the Foodwinc platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Foodwinc is an online food ordering and delivery platform that connects customers with local restaurants. We facilitate orders and coordinate delivery through our network of delivery partners.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
4. Orders and Payments
When you place an order through Foodwinc:
- Prices displayed are the actual restaurant prices
- Delivery fees are clearly shown before checkout
- Payment is processed securely through our payment partners
- Orders are confirmed once payment is successful
5. Order Cancellations and Refunds
Orders may be cancelled within a limited time after placement. Refund eligibility depends on the order status and circumstances. We will process eligible refunds within 5-7 business days to your original payment method.
- Before Restaurant Acceptance: Full refund if cancelled within 60 seconds of placing order
- After Restaurant Acceptance: Partial or no refund based on preparation status
- After Dispatch: No refund unless order is incorrect or damaged
- Quality Issues: Full or partial refund for genuine quality complaints with evidence
6. Restaurant Subscription Plans
Foodwinc offers subscription plans for restaurant partners to access our platform services. By subscribing to a plan, restaurants agree to the following terms:
- Plan Types: Monthly and annual subscription plans are available with varying features
- Billing Cycle: Subscriptions are billed at the start of each billing period
- Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
- Platform Commission: A commission percentage applies to each order as per the selected plan
- TDS Deduction: Tax Deducted at Source (TDS) under Section 194-O (1%) is applicable on restaurant earnings as per Indian tax law
7. Subscription Cancellation Policy
Restaurant partners may cancel their subscription at any time. The following terms apply:
- Cancellation Request: Submit cancellation through the restaurant app or by contacting support@foodwinc.com
- Effective Date: Cancellation takes effect at the end of the current billing period
- Access Until Expiry: Restaurant retains platform access until the subscription period ends
- Pending Orders: All pending orders must be fulfilled before cancellation is complete
- Pending Payouts: Outstanding earnings will be settled within 7 business days after cancellation
- No Mid-Cycle Cancellation: Cancellation does not terminate access immediately; service continues until period end
8. Subscription Refund Policy
Refunds for subscription payments are handled as follows:
- Within 7 Days: Full refund if cancellation is requested within 7 days of initial subscription and no orders have been processed
- After 7 Days: No refund for the current billing period; subscription remains active until period end
- Annual Plans: Pro-rata refund may be considered for annual plans cancelled within 30 days, minus any commission earned
- Technical Issues: Full or partial refund if platform was unavailable for extended periods due to our fault
- Refund Processing: Approved refunds are processed within 7-10 business days to the original payment method
- Non-Refundable: Setup fees, promotional discounts, and commission already processed are non-refundable
Important: To request a subscription refund, email billing@foodwinc.com with your restaurant ID and reason for refund. Requests are reviewed within 3 business days.
9. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Harass or abuse our delivery partners or restaurant staff
- Provide false information or impersonate others
- Attempt to manipulate pricing or promotions
- Interfere with the proper functioning of the Service
10. Intellectual Property
The Foodwinc name, logo, and all related content are the property of AG TRADERS. You may not use our intellectual property without prior written consent.
11. Limitation of Liability
Foodwinc acts as an intermediary between customers and restaurants. While we strive to ensure quality, we are not responsible for the food preparation or quality. Our liability is limited to the amount paid for the specific order in question.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
